Federal Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Detention
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without lawful basis.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The case stems from a erroneous removal to El Salvador in March, which the government later admitted was an mistake. Following his repatriation to the United States to answer human smuggling allegations, he was held in immigration detention.
In her order, the court pointed out that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
